a)Case A (650words )

 

Alice loves candy. Her favourite hobbies include chess, polo and jogging. She does not like oven potatoes or anything prepared in the oven though but she enjoys a gin and tonic every now and then. Additionally, she enjoys travelling and discovering new worlds.

 

One day, whilst wondering around Sugarland, a country regulated under English law, she entered a candy shop, the Blue Fontana. Before she entered the shop she noticed a big neon light advert outside of the shop stating:

 

‘Come on in while stocks last! Many items are currently half-price. Make us an offer!’

 

The shop is otherwise world-renowned for having candy for all tastes and appetites. It has candy of all sorts of colours and for almost all dietary needs: candy light, candy full sugar and candy vegetarian style.

 

Upon entering the candy shop, Alice cannot fail but notice the Big Marshmallow Man. ‘I’ll give you 1 golden coin for that one’ says Alice to the shop owner, Mr. John Candy. John replies ‘Make it 2 golden coins and it’s yours!’ Alice reluctantly agrees to this, hands over her one golden coin to John by saying that she will need a single day to bring the second golden coin for purchasing the marshmallow man.

 

Claudia, another resident of Sugarland, enters John’s shop after Alice left and sees the marshmallow man. She offers immediately two golden coins for the marshmallow man, John readily accepting this amount for selling the particular item. Claudia is very happy with her purchase and swiftly puts the marshmallow man with the help of John up in a lorry and goes away with it. The next day, when Alice entered the candy shop, John tells her sardonically: ‘Too late, I’m afraid! Here’s your golden coin. The marshmallow man has been sold to another customer! An oral agreement counts for nothing, Alice!’

 

Alice is upset and annoyed that she did not manage to purchase the marshmallow man but she is sure that she had a perfectly valid agreement with John Candy the day before Claudia purchased the marshmallow man.

 

On another occasion, Alice ordered 5 kittens from a pet shop by email on 20 September 2020. Two days later she found 5 similar kittens much cheaper elsewhere. On 22 September she left voicemail on the pet shop’s answering machine cancelling the original order and went ahead with buying the cheaper kittens she found. On the same day (22 September 2020) the original pet shop posted Alice a letter confirming the supply of kittens. Alice is worried about whether she has a contract with the original pet shop.

 

Advise Alice as to the law behind any contractual matters in the above scenarios. She would be interested to know the elements of contract formation with regard to each incident.

b) CASE B (600 words)

 

Graham visits his local sauna ’Steamin’ Hot’, and as always leaves his clothes in the changing room on a bench while he is in the sauna. On the wall of the changing room is a notice saying that the owners of the sauna will not be liable for any personal injury suffered on their premises. The notice also states that the owners will not accept responsibility for personal property lost or stolen on the premises. Graham is injured when he trips on a broken tile at the side of the sauna. Further his mobile phone and his new trainers are stolen from the changing room.

 

Graham wishes to sue ‘Steamin’ Hot’ but they are relying on the notice. Explain to Graham the law in relation to this area and advise him of his legal position.
